1. General terms and conditions

1.1. The owner of the website ritaliviajewelry.com (hereinafter Rita Livia Jewelry) is Rita-Livia OÜ (registry code 14273799). The following general terms and conditions of purchase apply to all legal relations between the persons (hereinafter the Customer) and Rita Livia Jewelry, which have arisen by visiting the Rita Livia Jewelry website and ordering goods from this online store.

1.2. Rita Livia Jewelry has the right to unilaterally change and renew the terms and conditions by publishing the updated information on the website: https://ritaliviajewelry.com/pages/terms-and-conditions. If the Customer has submitted an order before the new terms and conditions come into force, the terms and conditions valid at the time of making the purchase shall apply to the Customer.

1.3. By purchasing products from this online store the Customer agrees with terms and conditions of this Sales Agreement. The rights and obligations from the legislation of the Republic of Estonia also apply.

2. Placing an order

2.1. The Customer can place orders as an unregistered guest in the Rita Livia Jewelry Online Store.

2.2. The Customer selects a suitable product from the Rita Livia Jewelry Online Store and adds it to the shopping cart.

2.3. The Customer enters the contact information necessary for placing the order (name, email, telephone number, address)

2.4. The Customer confirms that they have read the general and purchase terms, privacy policy and payment and delivery terms of Rita Livia Jewelry.

2.5. The Customer chooses a suitable payment method from the payment processors offered by Rita Livia Jewelry (Maksekeskus, PayPal).

2.6. The Customer confirms the shopping cart order and pays for the order. Before making the payment, the Customer checks the compliance of the invoice with the cost of the order.

2.7. Rita Livia Jewelry will send a confirmation e-mail to the Customer together with the order information and invoice regarding the receipt of the order and payment.

2.8. The Sales Agreement between Rita Livia Jewelry and the Customer enters into force from the moment when the purchase amount paid by the Customer is received in full on Rita Livia Jewelry’s current account.

2.9. If Rita Livia Jewelry is unable to post the goods due to unforeseen reasons, Rita Livia Jewelry will notify the customer immediately and refund the purchase amount to the Customer as soon as possible, but not later than within 14 days.

3. Price and payment of goods

3.1. All products displayed in Rita Livia Jewelry online store are shown in euros. In the case of discounted promotional prices, the product page shows both the new price and the old price.

3.2. The Customer pays the entire purchase amount in advance for the order, which includes both the price of the goods and the transport fee.

3.3. The order is paid for outside the Rita Livia Jewelry online store in a secure payment environment. The Paypal payment environment is used for credit or debit card payments, and the payment environment of Maksekeskus AS for bank link payments. In the secure environment of Maksekeskus AS, the customer can pay with a bank link in the following banks: Swedbank, SEB, Luminor, LHV, Coop, Pocopay. Rita Livia Jewelry does not have access to the Customer’s credit card and bank account information.

4. Delivery of goods

4.1. The goods will be delivered to the address specified by the Customer.

4.2. Delivery of the goods within Estonia is free of charge. The international transport fee is € 10.

4.3. In certain regions outside the European Union postal items are subject to customs duties. All expenses relating to customs duties and fees are paid by the buyer, as soon as the package reaches its destination. We send all ordered items from Estonia (EU).

4.4. Delivery time in Estonia 1-5 days. International delivery time is 5-28 days.

4.5. The products are sent to the Customer as a standard package via postal service Omniva.

4.6. In case the Customer wishes the order to be sent to a package machine, the location specifications should be added during Checkout under Order Notes.

4.7. If upon receiving of the goods it turns out that the delivered goods are either incorrect, defective or have been damaged during transport, the Customer is obliged to inform Rita Livia Jewelry as soon as possible at ritaliviajewelry@gmail.com

5. Collection and processing of personal data

5.1. Rita Livia Jewelry collects and processes the following personal data of the Customer:

5.1.1. Customer’s first and last name;

5.1.2. Customer’s email address;

5.1.3. Customer’s phone number;

5.1.4. Customer’s address;

5.1.5. Information exchange between the Customer and Rita Livia Jewelry;

5.1.6. Customer’s IP address.

6. Use of cookies in the online store

6.1. Rita Livia Jewelry uses cookies to optimize Website traffic and to analyze Customer’s Website usage. If the Customer has not set his web browser in such a way that it refuses all or certain types of cookies, the cookies will be issued as soon as the Customer visits the Online Store.

6.2. Rita Livia Jewelry uses the following types of cookies:

6.2.1. Google Analytics cookies are used to analyze the Customer’s behavior in order to improve the Website. These cookies provide Rita Livia Jewelry with information about the number of Customers on the Website, the pages they visit and the length of time they spend on the Website. All information collected through cookies is combined with similar information received from other Customers and is therefore anonymous. Rita Livia Jewelry does not identify individual users.

6.2.2. Rita Livia Jewelry uses Facebook Pixel via Facebook to direct advertising to the Customer and to analyze the advertising flow, which in turn leads to the monitoring of the Customer’s web traffic by Facebook.

6.3. The Customer has always the option to check cookies through their browser settings. If the Customer prefers not to receive cookies, the Customer may configure the web browser to reject all cookies or send a warning when a cookie is issued.

7. Purpose of the processing of personal data

7.1. Personal data collected about the Customer is processed only for the purpose of providing the Service, enabling the provision of the Service, and enabling the use of the Online Store, inter alia for the following purposes:

7.1.1. To fulfill an order placed in the Online Store;

7.1.2. Online Store’s customer relationship management and customer communication;

7.1.3. Compilation and research of sales and customer base analytics;

7.1.4. Development of Online Store usability and services;

7.1.5. Improving the usability of the Online Store based on the data stored in cookies.

8. Method of processing personal data

8.1. The Customer’s personal data is processed only to the extent that has become known to Rita Livia Jewelry through the Online Store purchase process, through the preparation and fulfillment of the submitted order.

8.2. The personal data collected will be stored only for the purposes specified in clause 7 of these terms and conditions.

9. Storage and protection of personal data

9.1. All personal data collected about the Customer is stored on servers located in the countries of the European Union or the European Economic Area.

9.2. The personal data related to the Customer, which Rita Livia Jewelry uses for fulfilling the Agreement and to ensure the performance of the Agreement, shall be stored for up to 3 years from the receipt by the respective personal by Rita Livia Jewelry. The basic accounting documents are kept for 7 years in accordance with the Accounting Act.

9.3. Only Rita Livia Jewelry’s employees and members of the management bodies have access to the Customer’s personal data, who have the right to use the personal data only in connection with the provision of the Service and the management of the Online Store.

9.4. Rita Livia Jewelry may have additional obligations to retain certain personal information due to applicable law.

10. Sharing of personal data

10.1. Rita Livia Jewelry does not disclose the Customer’s personal data to third parties, except in the following cases:

10.1.1. For the provision of the service (for delivery of the order placed in the online store);

10.1.2. In order to make payments, the necessary personal data is forwarded to one authorized payment processor, according to the Customer’s choice at the payment stage of the purchase process.

10.1.3. To ensure fulfilling of the Sales Agreement;

10.1.4. Due to the sale of the company, in whole or in part, or the restructuring of the company. In this case, Rita Livia Jewelry will take all necessary measures to ensure the continued protection of the Customer’s personal data;

11. Customer’s rights in relation to personal data

11.1. The Customer has the right to access the personal data collected and processed about him/her and has the right to demand the correction of inaccurate personal data.

11.2. If the processing of personal data is prohibited in accordance with the applicable law, the Customer has the right to demand the termination of the processing of personal data and the closure or deletion of the processed personal data.

11.3. If the rights of the Customer are violated during the processing of personal data, the Customer has the right to apply to the Data Protection Inspectorate or a court, unless otherwise set by law.

11.4. If the Customer’s rights have been violated during the processing of personal data, the Customer has the right to demand compensation for the damage caused to him or her.

12. Exchange of goods

12.1. The Customer has the right to exchange the goods within 14 days after delivery of the goods, provided that the exchanged goods are undamaged and in original condition.

12.2. When exchanging goods for more expensive goods, the Customer pays the difference between the prices of the two goods.

12.3. When exchanging goods for less expensive goods, Rita Livia Jewelry will return the difference between the prices of the two goods to the current account provided by the customer within 14 days.

13. Returns and refunds

13.1. After receiving the order, the Customer has the right to withdraw from the contract concluded in the e-shop within 14 days.

13.1.1. The right of withdrawal does not apply if the Customer is a legal entity.

13.2. In order to apply the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.

13.3. If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or have signs of use or wear, Rita Livia Jewelry has the right to reduce the refundable fee according to the decrease in the value of the goods.

13.4. In order to return the goods, a withdrawal application must be submitted to the e-mail address ritaliviajewelry@gmail.com no later than within 14 days of receipt of the goods. In the withdrawal application, please indicate the order number and the date of receipt of the order.

13.5. The costs of returning the goods shall be borne by the Customer, unless the reason for the return is due to the fact that the goods to be returned do not correspond to what was ordered (eg incorrect or defective goods).

13.6. The Customer must return the goods within 14 days of submitting the application or provide proof that they have sent the goods to the designated address via a courier company or post office during the aforementioned period.

13.7. Upon receipt of the returned goods, Rita Livia Jewelry will return to the Customer immediately, but not later than 14 days after receiving the withdrawal application, all fees received from the Customer on the basis of the Agreement.

13.8. Rita Livia Jewelry may refuse to make refunds until the item that is the subject of the agreement has been returned or until the buyer has provided proof that they have returned the item, whichever comes first.

13.9. Rita Livia Jewelry has the right to withdraw from the sale transaction and demand the return of the goods from the Customer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.

14. Submission of claims

14.1. Rita Livia Jewelry is liable for non-compliance or defect of the goods sold to the Customer, which already existed at the time of delivery of the goods and which become apparent within two years from the delivery of the goods to the Customer. During the first six months from the delivery of the goods to the Customer, it is assumed that the defect already existed at the time of delivery of the goods. It is the responsibility of Rita Livia Jewelry to rebut this presumption.

14.2. In the event of a discovering a deficiency, the Customer has the right to contact Rita Livia Jewelry by sending an e-mail to ritaliviajewelry@gmail.com or by phone: +372 53416386 within two months.

14.3. Rita Livia Jewelry is not responsible for defects that have occurred after the delivery of the goods to the buyer.

14.4. If the goods purchased from Rita Livia Jewelry have defects for which Rita Livia Jewelry is responsible, Rita Livia Jewelry will repair or replace the defective goods. If the goods cannot be repaired or replaced, Rita Livia Jewelry will return to the Customer all fees associated with the Sales Agreement.

14.5. Rita Livia Jewelry will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.

15. Solving arguments

15.1. If the Customer has any complaints regarding Rita Livia Jewelry, they must be sent by e-mail to ritaliviajewelry@gmail.com or by phone: +372 53416386.

15.2. If the Client and Rita Livia Jewelry are unable to resolve the dispute by agreement, the Client may turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the agreement concluded between the Customer and the Online Store. The review of the Customer’s complaint in the commission is free of charge.

15.3. The buyer can turn to the European Union Consumer Dispute Resolution Platform.
